Child Nutrition Waiver Requests under SFSP 05-2018

The USDA has designed a process for State Agencies and eligible service providers to submit requests to waive requirements of Child Nutrition Programs, including the Child and Adult Care Food Program (CACFP) and the Summer Food Service Program (SFSP). Program requirements may be waived if the request would facilitate the State Agency or Service Provider to carry out the purpose of the program while remaining cost-neutral. This process is outlined fully in the memo, Child Nutrition Program Waiver Request Guidance and Protocol- Revised (SP 15-2018, CACFP 12-2018, SFSP 05-2018).

The State Agency wishes to inform CNP sponsors, site staff, and the public that the Department of Elementary and Secondary Education (DESE) has submitted two waiver requests to support the operation of the Summer Food Service Program (SFSP). The waiver requests are described below.

Expanding area eligibility to 45% in the SFSP:

In this waiver request, the State agency is seeking a waiver to 7 CFR 225.2(a) and (b) to expand area eligibility in the SFSP by increasing the percentage of participants eligible for free or reduced-price meals in the National School Lunch Program (NSLP) from at least 50% eligible for free and reduced-price meals, to at least 45% eligible.

This waiver is being requested in an effort to support the expansion of the Summer Food Service Program across the Commonwealth. The full waiver request is available for public review.

Extension of Area Eligibility Use for Closed Enrolled Sites in the Summer Food Service:

In this waiver request, the State agency is seeking a waiver in response to the SFSP Waiver for Closed Enrolled Sites, November 17, 2002, which was rescinded by SFSP 01-2019: SFSP Memoranda Rescission, October 11, 2018. The SFSP Waiver for Closed Enrolled Sites, November 17, 2002, extended area eligibility to closed enrolled sites. It also waived the statutory provision of Section 13(a)(1)(A)(i)(III) of the NSLA, 42 USC 1761(a)(1)(A)(i)(III) and the regulatory definition of closed enrolled sites, which required eligibility determinations to be made by submitting applications in accordance with 7 CFR 225.15(f).

Under this waiver, closed enrolled sites currently deemed eligible using area eligibility (either by school or census) would be able to operate as such until the expiration of their eligible status. This waiver request would only apply to existing closed enrolled sites utilizing area eligibility. The full waiver request is available for public review.
