Notice of Public Comment on the Proposed Rescission of 603 CMR 3.00, Occupational Schools Regulations

Pursuant to its authority under M.G.L. c. 75C, § 7; c.75D, § 8; and c. 93, § 21B, (all repealed), and Chapter 106 of the Acts of 2012, and in accordance with the Administrative Procedure Act, M.G.L. c. 30A, § 3, the Massachusetts Board of Elementary and Secondary Education (Board) is soliciting public comment on the proposed final rescission of the Occupational Schools Regulations, 603 CMR 3.00. The Occupational Schools Regulations are being rescinded because Chapter 106 of the Acts of 2012 transferred authority to regulate private occupational schools from the Department of Elementary and Secondary Education (ESE) to the Division of Professional Licensure (DPL). Effective December 30, 2016, DPL issued new regulations for licensed private occupational schools. The DPL regulations replace the previous Occupational Schools Regulations, 603 CMR 3.00. ESE filed notice of emergency rescission of the previous regulations and is inviting public comment, in accordance with the Administrative Procedure Act, before taking final action on the rescission. The deadline for submission of public comment is Friday, March 17, 2017. The Board is expected to vote on the final rescission at its regular monthly meeting scheduled for March 28, 2017.
