Pursuant to its authority under M.G.L. c. 69, § 1B, and c. 71, § 89, and in accordance with the Administrative Procedure Act, M.G.L. c. 30A, § 3, the Massachusetts Board of Elementary and Secondary Education is soliciting public comment on the proposed amendment to 603 CMR 1.00, Charter School Regulations.
The proposed amendment addresses the calculation of the list of districts in the lowest 10 percent, which is required by statute. The amendment is needed because we lack MCAS results from last spring due to the COVID-19 pandemic. To deal with this unprecedented situation, the proposed approach would add one sentence to the current regulation, effectively freezing for this year the list that was released in spring 2020. The amendment will not have any negative financial, procedural, or organizational impact on local governments.

The deadline for submission of public comment is May 28, 2021. The Board is expected to vote on the proposed permanent amendment at its regular monthly meeting in June 2021.
