The owners of the Quincy and the Malden franchises of Xintra Institute for Technology have filed for bankruptcy. On August 20, 2003, the owner of the Quincy location filed for bankruptcy (docket number 03-17065) and on August 27th the owner of the Malden location (docket number 03-17230) also filed for bankruptcy.

On August 27, 2003 the Department notified Xintra that the Department intends to revoke its license to operate and that they had fifteen days to request a hearing. Neither the owners of the Quincy nor the Malden locations requested a hearing with the Commissioner of Education in response to the Department's notice; therefore, the owners have been notified that effective September 16, 2003 the Department has revoked their license to operate a private occupational school in Massachusetts.

Students may file a claim for restitution of their tuition with the Department. Claim forms and instructions are available on our web-site. Please do not file a complaint with the Department of Elementary and Secondary Education (complaints are only for open schools); however, if you already have, please submit the completed and signed Claim for Restitution and we'll attach your complaint and supporting documents to the claim. All claims must be received by Monday, November 17, 2003.

Who is eligible to file a claim for tuition reimbursement?

• Students who paid for courses or programs of study and were not able to complete them due to the school's closing. This includes students who attempted to obtain refunds from the school prior to their closing, but were told by the school that the school did not have a refund policy. This also includes students to whom Xintra issued a Gold Card or other type of credit for prepaid courses.

Who is NOT eligible to file a claim for restitution of tuition?

• Students who have completed their program of study.
• Students who have obtained a discharge of student loans, reversals of credit card payments, or who were able to stop payments on bank or personal checks.

If students do not have a computer or are unable to download the forms, please call 781-338-6048 to request them to be sent. The Department will also hold help sessions for former Xintra students who need assistance filing claims for tuition restitution. We will post a bulletin by the end of September with dates and locations in both Quincy and Malden.

The Department will keep claimants informed by posting updated bulletins at each stage of the process. The Department greatly appreciates your help in keeping the volume of phone calls it receives to a minimum by checking these bulletins as it helps our small staff concentrate on completing the high volume of work experienced by this unit.
