School Suspensions, Revocations, and Expirations
In accordance with 603 CMR 3.17 and M.G.L. Chapter 30A, the Department may suspend or revoke the license or registration for cause.
Conditions of Suspensions:
Suspensions for expired building and/or fire inspection reports require that schools cease all operations until such reports are submitted to the Department of Elementary and Secondary Education (Department) in accordance with 603 CMR section 3.17(2). As such, the Department issues to these suspended schools orders to immediately cease and desist all operations. Students may not be allowed into the facility, nor may schools recruit, enroll, or accept tuition from current or prospective students until such time as the school is in compliance with the law.
Suspensions for failure to submit yearly financial statements to the Office of the State Auditor or for expired surety allow schools to have limited operations in accordance with 603 CMR section 3.17(3). As such, the Department of Elementary and Secondary Education issues to these suspended schools notice that they may provide instruction to current students, but shall not collect any tuition or fees from current or proscpective students. Additionally, these schools may not engage in advertising or promotion nor recruit or enroll new students until such time as the school is in compliance with the law.
