Regulations and Statutes

Private Occupational School Regulations 603 CMR 3.00

• 940 CMR 3.10 Regulations for Business Practices for Consumer Protection, the regulations describe unfair and deceptive trade practices regarding private occupational schools

The following statutes govern proprietary schools:

• M.G.L. c. 75D for private business schools
• M.G.L. c. 93 §21A for private trade schools
• M.G.L. c. 75C for correspondence schools
• M.G.L. c. 255, § 13K sets forth the guidelines for personal service contracts between certain schools and students; termination notice provisions required; applicability; violations; penalties

The following statutes and regulations also apply to proprietary schools:

• M.G.L. c. 112, § 74 - 81C - These statutes set forth the requirements for the establishment of nursing schools and licensed nursing practice.
• 244 CMR 6.00 - These regulations sets forth the requirements for schools seeking approval for practical nursing programs.
• M.G.L. C. 90, 119,§ 32G - This statute requires driving schools to also be licensed with the Registry of Motor Vehicles.
• M.G.L. c. 62C Sec. 49A - This statute requires any person applying for a license to operate a private school to comply with all laws relating to taxes, reporting of employees and contractors, and withholding.
• M.G.L. c. 71, Sec. 55B - This statute requires that school employees be tested for communicable tuberculosis. (repealed 2003)
