Guidance for Implementing IDEA 2004

Evaluations

	Statutory Language: Evaluations, Eligibility Determinations - On the left side we have provided you with the actual language from the statute. All of the bolded language is new language. The right side contains the summary of the new provisions, which includes important key points, some special notes to consider, relevant state requirements and more user-friendly language.
	Changes In Initial Evaluations And Reevaluations - Here we have taken a form developed by USDE/Office of Special Education Programs (OSEP), and have modified it to highlight Massachusetts- specific information.
	Summary of Student Performance - IDEA 2004 requires that the three sections you see included on this Summary of Performance form must be addressed in written form. HOW you address them is up to you. This form is provided as a tool to help you satisfy this new requirement.

We are anticipating additional clarification from OSEP when the final Federal regulations are issued. Until that time, we suggest you complete this information for every student who is graduating or whose age exceeds the age limit for provision of Special Education Services, triggering a termination of eligibility.
