Guidance on Time-Out Practices and Implementation of Amendments to 603 Code of Massachusetts Regulations CMR 46.00 and 603 Code of Massachusetts Regulations CMR 18.00

Purpose

In June 2025, the Board of Elementary and Secondary Education approved amendments to 603 Code of Massachusetts Regulations CMR 46.00, Prevention of Physical Restraint and Requirements If Used, and 603 Code of Massachusetts Regulations CMR 18.00, Program and Safety Standards for Approved Public and Private Day and Residential Special Education School Programs. These amendments reflect a continued focus on student safety, equity, and the appropriate use of behavioral supports. The amended regulations will take effect on August 17, 2026.

The guidance document is intended to:

  • Clarify definitions and regulatory requirements related to time-out practices;
  • Distinguish time-out from seclusion and other prohibited practices;
  • Provide implementation guidance and examples to support compliant and appropriate use;
  • Address common questions related to documentation, oversight, and monitoring; and
  • Support schools and programs in developing policies, training, and systems aligned with the amended regulations.

Department of Elementary and Secondary Education DESE encourages all districts, schools, collaboratives, and programs to review this guidance and begin planning for implementation well in advance of the effective date.
